 What is a FFL Firearm Transfer?

In simple terms, firearm transfer refers to the process of transferring ownership of a firearm from one Federal Firearms Licensee (FFL) to another FFL or to a non-licensee individual, often referred to as the transferee. In essence, any change of possession of an item constitutes a transfer, but when it comes to firearms, the term "transfer" typically involves the formal processing of the firearm through a licensed FFL dealer to a transferee as part of a firearm transaction. Since the implementation of the Gun Control Act of 1968 (GCA), firearms that cross state lines must be transferred through a Federal Firearms Licensee (FFL), regardless of whether the purchaser holds a handgun or firearm permit. However, firearm transactions within the same state, such as gifts, loans, or sales, do not necessitate the involvement of an FFL.

How FFL Dealer Transfers Work 

 Selection of FFL Dealer: Before initiating a transfer, individuals must choose an FFL dealer authorized by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Notification and Agreement: Sellers must inform their chosen FFL dealer of their intent to transfer a firearm. Upon agreement, the seller ships the firearm to the dealer's premises. Background Check: Upon receiving the firearm, the FFL dealer conducts a background check on the prospective buyer, ensuring they meet all legal requirements for firearm ownership. Completion of Transfer: Once the background check clears, the buyer can complete the necessary paperwork and take possession of the firearm from the FFL dealer.
